Terms of Service

These Terms of Service ("Terms") govern your access to and use of Kwizzy (kwizzy.online), operated by Ryteway Labs LLC ("Company," "we," "us," or "our"). By creating an account or using the service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to create an account. By registering, you confirm that you are 18 or older and have the legal authority to enter into this agreement. Joining a hosted game as a player (with a game code or QR code) and playing library quizzes require no account and have no age restriction, as players do not give personal data: they choose a nickname.

2. Account Registration

Accounts are created and managed through Supabase Auth, our authentication provider (sign-in by email link or by Google, Apple or Facebook account). You are responsible for:

• Keeping access to your email and sign-in provider accounts secure
• All activity that occurs under your account
• Notifying us immediately at support@kwizzy.online if you suspect unauthorized access

3. Subscription Plans and Billing

3a. Plan Tiers

Kwizzy offers the following plans:

• Free: Play every quiz in the public library with no account. With a free teacher account: save up to 5 quizzes of up to 10 questions each (with pictures), play them solo, and host up to 5 live games a month with up to 40 players each.
• Pro ($6.99/month or $59.99/year): Unlimited saved quizzes of up to 30 questions each, AI quiz generation, up to 100 live games a month with up to 50 players each, plus post-game reports and CSV export.

Plan limits are enforced when you create quizzes and host games. If a subscription ends, nothing is deleted: quizzes over the Free limit become read-only (you can still play, host and delete them). We reserve the right to modify plan pricing with 30 days' notice to existing subscribers.

3b. Billing and Payments

Paid subscriptions are billed in advance on a monthly or annual basis. Payments are processed securely by Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring basis until you cancel.

3c. Cancellation

You may cancel your subscription at any time through the Manage Billing portal on your Dashboard (powered by the Stripe Customer Portal). Cancellation takes effect at the end of the current billing period. You will retain access to paid features until then.

3d. Plan Downgrade Effects

If your subscription lapses or you downgrade to the Free plan, your account will revert to Free plan limits. Existing quizzes beyond the first 5 will become read-only but will not be deleted. You may delete quizzes to restore edit access within Free plan limits, or resubscribe to regain full access.

4. Content and Intellectual Property

4a. Your Content

You retain full ownership of the quiz content you create or generate using Kwizzy ("Your Content"). This includes uploaded documents, URLs submitted for parsing, and the resulting quiz questions and answers.

4b. Material You Give the AI

Documents, photos, web pages and videos you give the AI to write questions from remain the property of whoever owns them. Only use material you have the right to use, for example your own, your school's, or material that is openly licensed or that you may use for teaching. Kwizzy writes new questions in its own words and does not store or republish the material, but the right to use it for your quiz is yours to confirm, and you are responsible for it.

Quizzes from YouTube videos (Max plan) work only with public videos, which Google's AI reads directly from YouTube: Kwizzy does not download or keep the video. Kwizzy uses YouTube API Services, so by using this feature you agree to be bound by the YouTube Terms of Service. A video's owner can ask YouTube to remove it, and you should not use a video if its owner does not allow this use. If a rights holder contacts us, we may remove the quiz questions made from their material.

4c. License to Kwizzy

By using the service, you grant Ryteway Labs LLC a limited, non-exclusive, royalty-free license to host, store, display, and transmit Your Content solely for the purpose of providing the service to you and your students. This license terminates when you delete your account.

4d. Kwizzy IP

The Kwizzy platform, brand, software, and visual design are owned by Ryteway Labs LLC and protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works without our written consent.

5. AI-Generated Content

5a. Acceptable Use of AI Features

When using Kwizzy's AI quiz generation features, you agree not to:

• Submit content that is illegal, defamatory, obscene, or violates any third party's rights
• Generate quizzes containing hateful, discriminatory, or harmful content
• Use Kwizzy to facilitate academic fraud or cheating
• Attempt to extract, scrape, or reverse-engineer the AI models or API responses
• Upload documents containing sensitive personal data or student records
• Use the service for any purpose other than legitimate educational use

6. Player Privacy and Children

Players join hosted games anonymously with a game code or QR code, and library quizzes are played without an account. Players choose a nickname, which is stored with their score for the game's leaderboard. If you use Kwizzy with children (for example in a classroom), you are solely responsible for ensuring your use complies with applicable laws, school or district policies, and parental consent requirements. Accounts are for adults (18+) only.

7. Acceptable Use

You agree not to use Kwizzy to:

• Violate any applicable law or regulation
• Transmit malware, viruses, or any malicious code
• Attempt unauthorized access to the platform or other users' accounts
• Use automated tools to scrape, crawl, or overload our systems
• Resell or sublicense access to the service without written consent

We reserve the right to suspend or terminate accounts that violate these terms without refund.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RYTEWAY LABS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE.

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO KWIZZY IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).

10. Indemnification

You agree to indemnify and hold harmless Ryteway Labs LLC and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the service, your violation of these Terms, or your violation of any rights of a third party.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict of law principles. Any dispute arising from these Terms shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, in Seattle, Washington. Notwithstanding the foregoing, either party may seek injunctive relief in a court of competent jurisdiction.

12. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email to registered accounts at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you must cancel your account before the effective date.

13. Termination

You may terminate your account at any time: cancel any subscription (through the Stripe Customer Portal), then use “Delete account” on your Account page. Your data is permanently deleted 90 days later, and you can restore the account before then. You can also contact us at support@kwizzy.online. We may suspend or terminate your access for violation of these Terms, non-payment, or at our discretion with 30 days' notice (except in cases of serious violations, which may result in immediate termination).
