Terms of Service

These Terms of Service ("Terms") govern your access to and use of Kwizzy (kwizzy.online), operated by Kwizzy Inc. ("Company," "we," "us," or "our"). By creating an account or using the service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to create a teacher account. By registering, you confirm that you are 18 or older and have the legal authority to enter into this agreement. The student-facing experience (joining sessions by PIN) has no age restriction, as no personal data is collected from students.

2. Account Registration

Teacher accounts are created and managed through Clerk, our authentication provider. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately at support@kwizzy.online if you suspect unauthorized access

3. Subscription Plans and Billing

3a. Plan Tiers

Kwizzy offers the following plans:

  • Free: 3 quizzes, up to 10 questions each, up to 10 students per session, Manual Sync mode only
  • Pro ($19/month or $190/year): Unlimited quizzes, up to 30 questions each, up to 50 students per session, all session modes
  • Growth ($79/month or $790/year): Unlimited quizzes, up to 100 questions each, up to 500 students per session, all session modes, priority support

Plan limits are enforced at the time of quiz creation and session launch. We reserve the right to modify plan pricing with 30 days' notice to existing subscribers.

3b. Billing and Payments

Paid subscriptions are billed in advance on a monthly or annual basis. Payments are processed securely by Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring basis until you cancel.

3c. Cancellation

You may cancel your subscription at any time through the Manage Billing portal on your Dashboard (powered by the Stripe Customer Portal). Cancellation takes effect at the end of the current billing period. You will retain access to paid features until then.

No Refunds Policy: All subscription payments are non-refundable. We do not provide prorated refunds for unused portions of a billing period. If you cancel a yearly plan mid-year, you retain access for the remainder of the year but will not receive a refund. If you have a billing dispute, contact us at support@kwizzy.online and we will work in good faith to resolve it.

3d. Plan Downgrade Effects

If your subscription lapses or you downgrade to the Free plan, your account will revert to Free plan limits. Existing quizzes that exceed the 3-quiz limit will become read-only but will not be deleted. You may delete quizzes to restore edit access within Free plan limits, or resubscribe to regain full access.

4. Content and Intellectual Property

4a. Your Content

You retain full ownership of the quiz content you create or generate using Kwizzy ("Your Content"). This includes uploaded documents, URLs submitted for parsing, and the resulting quiz questions and answers.

4b. License to Kwizzy

By using the service, you grant Kwizzy Inc. a limited, non-exclusive, royalty-free license to host, store, display, and transmit Your Content solely for the purpose of providing the service to you and your students. This license terminates when you delete your account.

4c. Kwizzy IP

The Kwizzy platform, brand, software, and visual design are owned by Kwizzy Inc. and protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works without our written consent.

5. AI-Generated Content

Important: Quiz questions are generated by Google Gemini, an AI system. AI-generated content may contain factual inaccuracies, oversimplifications, or errors. You are responsible for reviewing and validating all AI-generated questions before use in a classroom setting. Kwizzy does not warrant the accuracy, completeness, or pedagogical appropriateness of any AI-generated content.

5a. Acceptable Use of AI Features

When using Kwizzy's AI quiz generation features, you agree not to:

  • Submit content that is illegal, defamatory, obscene, or violates any third party's rights
  • Generate quizzes containing hateful, discriminatory, or harmful content
  • Use Kwizzy to facilitate academic fraud or cheating
  • Attempt to extract, scrape, or reverse-engineer the AI models or API responses
  • Upload documents containing sensitive personal data or student records
  • Use the service for any purpose other than legitimate educational use

6. Student Privacy and COPPA

Kwizzy is designed for use in K-8 classrooms and is built to be compliant with the Children's Online Privacy Protection Act (COPPA) and the Family Educational Rights and Privacy Act (FERPA). Students join sessions anonymously by PIN — no personal information is collected from students. Teachers are solely responsible for ensuring their use of Kwizzy complies with applicable school district policies and parental consent requirements.

7. Acceptable Use

You agree not to use Kwizzy to:

  • Violate any applicable law or regulation
  • Transmit malware, viruses, or any malicious code
  • Attempt unauthorized access to the platform or other users' accounts
  • Use automated tools to scrape, crawl, or overload our systems
  • Resell or sublicense access to the service without written consent

We reserve the right to suspend or terminate accounts that violate these terms without refund.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KWIZZY INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE.

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO KWIZZY IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).

10. Indemnification

You agree to indemnify and hold harmless Kwizzy Inc. and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the service, your violation of these Terms, or your violation of any rights of a third party.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict of law principles. Any dispute arising from these Terms shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, in Seattle, Washington. Notwithstanding the foregoing, either party may seek injunctive relief in a court of competent jurisdiction.

12. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email to registered teacher accounts at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you must cancel your account before the effective date.

13. Termination

You may terminate your account at any time by canceling through the Stripe Customer Portal and contacting us at support@kwizzy.online to request data deletion. We may suspend or terminate your access for violation of these Terms, non-payment, or at our discretion with 30 days' notice (except in cases of serious violations, which may result in immediate termination).
